Terms of Service

By accessing or using thama.app (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

The Service is operated by Franger Centeno, an independent professional based in Portugal (“we”, “us”, or “Thama”). You must be at least 16 years old to create an account or use the Service.

Thama provides a platform for creating and sharing virtual business cards. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible. We do not guarantee uninterrupted or error-free availability of the Service.

You are responsible for maintaining the confidentiality of your account credentials. You agree to use one account per person and to provide accurate information when registering.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or cause harm to other users or to the Service.

You retain ownership of all content you upload or publish through the Service, including your profile photo, bio, and links (“User Content”).

By publishing User Content on Thama, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute that content solely for the purpose of operating the Service.

You are solely responsible for ensuring your User Content does not infringe the rights of any third party. The following types of content are prohibited:

• —Content that is illegal, defamatory, or fraudulent
• —Impersonation of another person or entity
• —Spam or unsolicited commercial content
• —Content that promotes violence, harassment, or hate
• —Malware or any code intended to harm

We reserve the right to remove any content that violates these Terms without prior notice.

You agree not to:

• —Use the Service for any unlawful purpose
• —Attempt to gain unauthorized access to other users' accounts or data
• —Scrape, crawl, or systematically extract data from the Service without written permission
• —Interfere with or disrupt the integrity or performance of the Service
• —Distribute malicious code or engage in any activity that could harm the Service or its users

Payments for Thama subscriptions are processed by Polar.sh, who acts as the Merchant of Record. By purchasing a subscription, you also agree to Polar's Terms of Service.

We reserve the right to update pricing with reasonable advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

No refunds. All purchases are final. By completing your subscription purchase, you acknowledge that the Service is made immediately available to you and you expressly waive your right of withdrawal under applicable consumer protection law, to the extent permitted.

If you cancel your subscription, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free plan.

The Thama name, logo, design, and underlying software are the property of Franger Centeno and are protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute any part of the Service without prior written permission.

To the fullest extent permitted by law:

• —Thama is provided "as is" without warranties of any kind
• —We are not liable for any loss of data, revenue, or profits arising from your use of the Service
• —Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

These Terms are governed by the laws of Portugal. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Portugal.

For EU consumers, nothing in this clause affects your rights under mandatory consumer protection laws applicable in your country of residence.

We may update these Terms from time to time. When we do, we will notify you via email or through a notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
